Deferred Action for Childhood Arrivals (DACA)
Deferred Action for Childhood Arrivals or “DACA” allows certain individuals who arrived in the U.S. as children and are no longer in lawful status to request that removal action against them be deferred for 2 years, subject to renewal. It also allows eligible applicants to apply for employment authorization. Furthermore, it permits applicants to apply for travel authorization which may be approved if there are justifiable reasons for the international travel.
In order to qualify for DACA, the applicant must:
Be under the age of 31 as of June 15, 2012;
Have arrived in the United States before reaching his or her 16th birthday;
Have continuously resided in the United States since June 15, 2007, up to the present time;
Be physically present in the United States on June 15, 2012, and at the time of making the DACA request;
Have had no lawful status on June 15, 2012;
Be currently in school, have graduated or obtained a certificate of completion from high school, have obtained a general education development (GED) certificate, or be an honorably discharged veteran of the Coast Guard or Armed Forces of the United States and;
Have not been convicted of a felony, significant misdemeanor, or three or more other misdemeanors, and does not otherwise pose a threat to national security or public safety.
